A Crestwood man accused of rape and sodomy after he fled to Miami with a 15-year-old girl in 2011 has been indicted for additional criminal charges.
Toby Mason, now 54, skipped town in May 2011 with a teenager he met while playing video games. The teenager had packed clothes and toiletries during the night and left a note on her pillow explaining she wanted an adventure.
Ten days later, U.S. Marshals located the teenager in a Miami motel room with Mason and another man. Mason did not have a car, and the teenager did not have a driver’s license.
In 2011, an Oldham County grand jury indicted Mason for unlawful transaction with a minor 16 or younger involving an illegal sexual act; unlawful transaction with a minor 16 or younger involving an illegal controlled substance; five counts rape; five counts sodomy; and custodial interference.
His trial was scheduled to begin Monday, but has since been postponed.
